Terms and Conditions for Tsaleach Global Pty Ltd T/A Car Rental Plus

Welcome to www.carrental-plus.com (“our website”). By accessing or using our services, you agree to be bound
by these Terms and Conditions (“Terms”). Please read them carefully. If you do not agree to these Terms, do
not use our services.

1. Definitions
- Brochure means the pamphlet published by us containing our current tariffs, including
Rates Sheets available on request.
- The Customer means jointly and severally, the signatory hereto and any person on whose
behalf the signatory signs this agreement.
- Damages (in relation to the Vehicle) include expenses for towing, transporting,
storing, repairing damage from delivery until return, replacing parts or accessories (excluding normal
wear and tear), and paying an expert for damage inspection and report (with invoices or quotations as
prima facie proof).
- Extended Period means the period after the Return Date, requested by you and agreed
upon by us in writing, with a Reference Number.
- Rental Period means the duration starting from delivery of the Vehicle (per clause 4.2)
until the Return Date or the end of the Extended Period, if applicable.
- Return Date means the date specified on the rental agreement when the Vehicle must be
returned.
- Vehicle refers to the vehicle described on the agreement or any approved substitute.
- Exceptions Liability is double the liability waiver amount specified on the face of the
agreement.
2. Driver Eligibility and Authorized Drivers
- By signing this agreement, you confirm that you hold a valid, unendorsed driver’s license.
- We reserve the right to verify your license validity and may refuse rental if your license has been
suspended, revoked, or restricted.
- Additional drivers are only permitted if they are named on the agreement, pay an additional driver fee,
and have held a valid, unendorsed driver’s license for at least two years.
3. Rental Terms
- We rent you the Vehicle for the Rental Period at the rate specified on the agreement, plus any
applicable additional charges. Rates are based on the Brochure or other agreed terms. You are
responsible for all taxes and fees, including fuel.
- Payments are due upon demand, but no later than the expiry of the Rental Period. You may not set off or
withhold any amounts owed.
- If payment is overdue, we may charge interest at the highest permitted rate under the Consumer
Protection Act.
- Returning a long-term rental or lease prior to the agreed date will result in forfeiture of your deposit
and may affect your eligibility for discounted rates.
4. Delivery and Collection
- Delivery may be refused if advance payment or deposit is unpaid.
- You shall collect the Vehicle at the specified location. If not available, your sole remedy is a refund
of any amount paid. On delivery, the Vehicle is deemed in good order unless you notify us within 2 hours
and obtain a Reference No.
- You are responsible for all fuel costs to and from the delivery/collection point.
- On Return Date, you shall:
- Return the Vehicle at your risk and expense to the specified location unless otherwise arranged
and approved.
- Pay for all damages and losses incurred.
- Pay for valet cleaning if requested.
5. Your Obligations
- The Vehicle and keys are at your sole risk during the Rental Period.
- You shall not:
- Hire or lend the Vehicle or keys to unauthorized persons.
- Allow persons other than authorized drivers to operate the Vehicle.
- Use the Vehicle unlawfully, for illegal purposes, or in a manner that could increase risk of
damage or loss.
- Use the Vehicle for purposes outside personal transportation within your party.
- Expose the Vehicle to civil unrest or damage during unrest.
- Take all steps to secure the Vehicle, including locking and immobilizing when not in use.
- In the event of an accident, theft, or damage:
- Report to us and police within 1 hour.
- Complete all necessary documents.
- Assist us with investigations or claims.
- Do not undertake towing, repairs, or servicing without our prior written approval. Unauthorized
repairs are payable by you.
- If driven by anyone other than you, you remain liable for all obligations.
- We may terminate the rental at any time.
- In case of theft where keys are lost, you are responsible for the full vehicle value.
- Keys must be returned with RFID keyrings or keytags. Lost keyrings incur a R100 surcharge.
- You must provide card or bank details for refunds at the start of rental; otherwise, a R100 admin fee
applies for manual refunds.
6. Damage and Loss Waivers
- Damage and Loss Waivers Declined
- Without waivers, you are liable for all damages, theft, or loss, including replacement at retail
value (depreciated monthly) and salvage value.
- Damage and Loss Waivers Accepted
- If you accept the damage and theft waiver, and comply with all terms, your liability is limited
to the amount specified on the agreement plus fuel and towing costs.
- Failure to report accidents, provide proper documentation, or comply with traffic laws may void
the waiver and make you fully liable.
- Double liability applies in cases of theft parked in streets, single-vehicle accidents, damages
under adverse conditions, or when proper third-party details are not obtained.
- Third-Party Claims
- You are responsible for third-party claims resulting from your use of the Vehicle unless
expressly covered under the waiver.
- The waiver does not cover: undercarriage damage, water damage, or damages caused by negligence.
7. Personal Accident Insurance
We do not provide personal accident insurance. It is your responsibility to insure passengers against injury
or loss.
8. Exemptions and Liability
We are not liable for damages caused by vehicle defects, mechanical failures, or driver negligence. No
warranties are given regarding vehicle condition, performance, or suitability beyond what is expressly
stated.
9. Tracking Devices & POPIA
- The Vehicle is fitted with a tracking device for safety, law enforcement, and liability purposes.
- Data from tracking devices and cellphone triangulation may be used to recover stolen vehicles or
investigate incidents.
- Reckless driving may result in contract termination or charges, including a R5000 recovery fee if the
vehicle is not returned within 4 hours.
- We may share personal data for traffic fines, debt collection, or criminal investigations.
10. General Provisions
- Notices shall be sent to the address on the agreement and are deemed received after 7 days unless proof
of earlier receipt is provided.
- You consent to the jurisdiction of South African courts, including the Magistrates' Court or High Court.
- The English version of these Terms prevails in case of dispute.
- No variation or cancellation is valid unless in writing and signed by both parties.
- We may recover costs and expenses incurred due to your breach of these Terms.
- If any provision is invalid or unenforceable, it shall be severed without affecting the rest of the
agreement.
- This agreement is governed by South African law.
- Additional terms in vehicle manuals and traffic laws form part of this agreement.
- We may perform credit checks or other verifications as needed.
- A redirection fee of R400 applies to traffic fines; a copy costs R300 per fine.
- All tolls will be charged at the prescribed rate plus R50 admin fee.
- Rental extensions must be paid before the original period ends; late payments incur R110/day fee.
- Overdue vehicles recovered at a R5000 fee; R1000 fee applies for payment to recovery agents.
- Vehicles are allocated by group; specific models are not guaranteed.
- Daily rates are based on a 24-hour cycle.
- Cancellation refunds: more than 7 days prior, 100%; within 7 days, 75%; less than 24 hours, 50%.
- Excess mileage is billed at the current rate; unused mileage may be refunded.
- Excessive or abusive vehicle usage may lead to additional charges or termination.
- Personal information may be shared with loyalty programs, subject to law.
11. Cross-Border Travel
- Cross-border travel requires a special letter obtained at R1400 to Botswana, Lesotho, Swaziland, or
R3000 to Zimbabwe or Mozambique. Processing takes 3 days.
- Cross-border rentals are only available for bookings of 7 days or more and must be paid via credit card.
- Cross-border travel doubles the deposit.
- We reserve the right to determine permissible vehicles for cross-border trips.
- If denied entry outside South Africa, we are not liable.
- You are responsible for all taxes, fines, and costs incurred outside South Africa.
- Repairs outside SA require prior approval.
- Vehicles must be returned to a South African branch.
12. Marketing and Data Use
We may use your contact details for marketing, but you can opt out at any time. Your data will not be sold.
13. Delivery and Refunds
- Delivery is subject to vehicle availability and payment.
- Refunds for cancellations depend on timing: more than 7 days before, full refund; within 7 days, 75%;
less than 24 hours, 50%.
14. Payment Methods & Security
Payments accepted via Visa, MasterCard, Diners, American Express, or bank transfer. Card transactions are
processed securely via PayGate, using SSL encryption; no card details are stored on our servers. Customer
details are stored separately from card details.
15. Responsibility & Liability
We are not liable for damages caused by vehicle defect or driver negligence. You agree to care for the
Vehicle and adhere to all traffic laws. You acknowledge that you are responsible for all legal costs if you
breach these Terms.
16. Governing Law & Jurisdiction
These Terms are governed by South African law. Disputes will be resolved in courts of South Africa.
17. Miscellaneous
- We may change these Terms without notice.
- If any part is invalid, the rest remains enforceable.
- The entire agreement includes these Terms and the “Important Facts” sheet.
By using our services, you acknowledge that you have read, understood, and agree to these Terms and
Conditions.
